The High Court on Monday declared the dismissal of Dhaka Water Supply and Sewerage Authority’s deputy managing director Syed Mohammad Golam Yeazdabni on June 22, 2023, illegal.

Yeazdabni was dismissed after he disclosed irregularities, involving DWASA managing director Taqsem A Khan, to the media.

The bench of Justice Sheikh Hassan Arif and Justice Md Bazlur Rahman pronounced the verdict after disposing of a writ petition, filed by Yeazdabni in 2023, challenging the legality of his removal without a hearing and without prior government approval.

‘DWASA is a statutory body, and its activities cannot be dictated by the whims of the executive members of its board,’ observed the court.

Yeazdabni had been given a contractual appointment as DWASA DMD (administration) for three years on May 16, 2022, and was due to retire on May 15, 2025.

According to Yeazdabni’s lawyer, Humaun Kabir Pallob, the officer could not be removed from his position unless he violated the service rules for his contractual appointment.

However, Yeazdabni was removed illegally due to a personal conflict with Taqsem, who had complained to the DWASA board, following their private conflict.

Yeazdabni was not given an opportunity to defend himself or appear before the DWASA board, the lawyer added.
