The Appellate Division of the Supreme Court on Thursday upheld the High Court order for accepting the nomination paper of Shahadat Hossain, younger brother of Awami League general secretary Obaidul Quader, in the upcoming Companiganj Upazila Parishad election.

A seven-member bench of the Appellate Division led by Senior Justice M Enayetur Rahim passed the order.


Advocates Ekramul Haque Tutul, Taposh Kumar Biswas and Tamanna Ferdous stood for Shahadat while Advocate Sheikh Mohammad Morshed for another candidate Golam Sharif.

On May 14, the high court ordered the authorities concerned to accept the nomination paper of Shahadat as a chairman candidate in Noakhali鈥檚 Companigonj upazila parishad election slated for May 29.

Four people, including Quader鈥檚 younger brother Shahadat Hossain, submitted nomination papers to contest the polls.

The remaining candidates were Upazila Juba League鈥檚 former convener and businessman Mohammad Golam Sharif Chowdhury Piplu, former upazila parishad chairman and upazila Awami League鈥檚 incumbent general secretary Mizanur Rahman Badal and US expatriate Omar Ali.

On May 5, Shahadat鈥檚 nomination paper was rejected on charge of concealing information regarding cases and income in the affidavit during scrutiny.

Later, he submitted an appeal to Noakhali鈥檚 deputy commissioner and returning officer Dewan Mahbubur Rahman who also rejected his nomination paper after a hearing on May 9.

Shahadat Hossain filed a petition with the HC challenging the order.
