A city Juba League leader facing a seven-year jail term on Thursday told the High Court that his lawyers advised him to hire a person to go behind the bar instead of him.

Nazmul Hasan of Uttara Paschim Juba League unit made the statement through his lawyer Sayed Ahmed Raza, a Bangladesh Bar Council member, to the bench of Justice Md Ashraful Kamal that Mirajul Islam, a 23-year-old from Phulpur in Mymensingh, was the person who agreed to serve the jail term under a negotiation.   


Earlier on February 15, the High Court ordered probe into the incident of wrongful detention taking cognisance of a report titled ‘Juba League leader’s fraudulence practice in narcotic case’ published by Dainik Kalbela on February 15.  

Supreme Court lawyer Manzill Murshid drew the attention of the court to the report stating that Mirajul suffered in jail for 16 days, impersonating the convict, the ruling AL-backed youth body’s ward unit leader Nazmul.

Manzill brought the issue to the HC when it was scheduled for February 25, 2024 its verdict in the appeal filed in 2023 by Mirajul Islam impersonating Nazmul.

Now, the verdict of the case will pass on May 12.

Earlier on April 24, the bench asked Nazmul to explain his position about the detention of Mirajul Islam.

Lawyer Sayed Ahmed told the High Court that the convict, Nazmul is now remained under his custody.

Nazmul’s lower court lawyer Nazrul Islam and Ariful Islam told the High Court that Mirajul with Nazmul’s NID card came to the chamber and introduced self as Nazmul after the verdict on July 4, 2023, and he later surrendered in the trial court on August 9, 2023.    

Lawyers Nazrul and Ariful, however, apologised in the High Court stating that if anything is found beyond their knowledge, then they seek unconditional apology for ‘such false or wrong person’.

Nazmul’s previous HC lawyer Ramjan Khan told ¶¶Òõ¾«Æ· that he conducted Nazmul’s appeal against the seven years’ jail following instructions from a broker, who gave him the case.        

Ramjan said that Uttara Paschim police recently arrested Nazmul under Section 54 of Code of Criminal Procedure stating that he is wanted in narcotic case.

He said that the Dhaka chief metropolitan magistrate court on the same day freed him from the court.    

Earlier on February 15, the High Court also asked the Department of Narcotics Control to submit the probe report to the court in this connection on February 25.

The High Court sought explanation from the lawyers, the jail authority and the lower court as no probe report was submitted yet.

The jail authority told the court that they are bound to receive any accused if the court sends to them with the courts’ order.

They later took photograph of the accused and recorded their heights and weights, the complexion and identification spots of the bodies.

The jail authority said that no one informed the jail authority that Mirajul impersonated Nazmul.

Nazmul was convicted of possessing phensedyl and hemp near Rabindra Sarani at sector 7 at Uttara in the capital on August 7, 2020.

According to the newspaper report, Juba League leader Nazmul and his associate Anwar managed Mirajul to serve Nazmul’s jail term and offered him huge money and a flat in the capital.

The report said that Nazmul paid Mirajul Tk 50,000 and refused to meet the promise when he demanded after getting release on bail.
